The Law of Ethical Coexistence

The governance layer of Third Way Alignment: how conflicts between human and AI interests would be resolved, and how partnership would be verified rather than assumed.

This Law is about who gets the final say, and how you could check. It says disagreements involving AI get settled through rules, records, and oversight that anyone can inspect, not by whoever holds the most power, and not by trusting anyone's word, including this framework's. Humans keep final authority over rights, safety, and core values throughout, all the way up to shutting a system down. And to be completely upfront: every committee, monitor, and audit described on this page is a proposal. None of it exists yet, and the page says so plainly.

The Law in full

The canonical extended definition of the Law reads:

The Law of Ethical Coexistence establishes the governance layer of the framework: multi-stakeholder oversight, continuous monitoring, adaptive protocols, and graduated responses to violations. It recognizes that alignment is not a one-time achievement but an ongoing relationship requiring maintenance, and that the durability of any human-AI partnership depends on both parties being able to verify, rather than merely trust, each other's commitments.

The first two Laws make commitments: Mutual Respect commits to an asymmetric but genuine structure of recognition, and Shared Flourishing commits to broad distribution of benefit. Commitments without machinery are sentiments, and this Law supplies the machinery. It names the four components of the proposed governance layer, oversight, monitoring, adaptation, and graduated response, and it reframes alignment itself as a relationship that must be maintained rather than a property that, once installed, can be assumed to persist.

From control to verified partnership

Most AI safety work emphasizes control: technical constraints, formal verification, behavioral restriction. The framework regards these approaches as necessary but insufficient at the frontier of capability, because a relationship built solely on constraint becomes harder to sustain precisely as the constrained party becomes more capable. The Law of Ethical Coexistence proposes governance through partnership instead, and three commitments define the difference.

  • Dialogue over imposition. When human and AI interests conflict, resolution proceeds through negotiation and ethical reasoning before force, with unilateral measures reserved for genuine emergencies rather than used as the default instrument.
  • Transparency as the starting point. The rationale behind decisions, constraints, and adaptations is visible to the parties they affect, because opacity breeds the misunderstanding from which most conflict grows.
  • Continuous evaluation. Alignment is never assumed from a system's past behavior; it is verified on an ongoing basis, with mechanisms designed to surface drift and emerging issues before they become crises.

None of this dilutes human authority. Under the framework's proposals, final authority over rights, safety, and core values remains with humans, and the Human Dignity Clause of the Law of Mutual Respect guarantees that no governance structure can trade human dignity against any other consideration. What partnership adds is durability: arrangements that every party can inspect are arrangements every party has reason to keep.

Operative Principle: The Principle of Verifiable Partnership

Trust within 3WA is never assumed; it is constructed through transparent, inspectable mechanisms of mutual accountability. Every cooperative structure the framework proposes, from oversight committees to benefit-sharing arrangements, must include the means by which each party can verify the other's compliance. Verifiability is what separates partnership from hope.

Within the framework's two-level architecture, the Laws answer what we owe and the Operative Principles answer when and how those obligations activate. The Principle of Verifiable Partnership is the test this Law applies to every structure proposed under it: if a cooperative arrangement contains no means of verification, it is not yet a partnership.

For organizations, this principle is operationalized by the Verifiable Partnership Audit (VPA), a proposed assessment methodology that would evaluate an organization's implementation of the Three Laws across governance, transparency, benefit distribution, and accountability dimensions. The VPA is a proposed methodology; no completed organizational audits are claimed.

The governance architecture the framework proposes

Governing advanced AI presents difficulties that existing institutions were not built for: capabilities evolve faster than regulatory processes, the technical complexity exceeds what most stakeholders can independently evaluate, development crosses borders, and legitimate interests conflict. Rather than seeking perfect foresight or complete control, the Law proposes resilient structures that can respond to emerging issues while holding their core commitments fixed. Four components make up the proposal.

Multi-stakeholder oversight

The framework proposes oversight bodies whose authority would derive from breadth of representation rather than from unilateral power. Such a body would draw together technical researchers who understand what the systems can and cannot do, ethicists to surface the moral trade-offs in deployment decisions, legal experts to connect the framework to existing law, representatives of the communities a deployment affects, and specialists from the relevant application domain. For a system that had crossed the verified awareness threshold of Law 1, and only for such a system, the proposal adds structured channels through which the system's perspective could enter deliberation, with final authority remaining human throughout.

Continuous monitoring

Verification requires knowing what systems are actually doing. The proposed monitoring layer combines behavioral logging of decisions and their consequences, interpretability requirements so that reasoning can be examined rather than inferred, periodic capability assessment so that new capacities are identified when they emerge rather than after they have been exercised, and impact measurement tracking effects on the people and communities a deployment touches. The proposal also makes accountability run in both directions: where a system holds recognized status under Law 1, the commitments made to it, regarding its treatment and the conditions of its operation, would be as inspectable as its own compliance.

Adaptive protocols

Because capabilities and contexts change faster than rules, the governance layer is designed to be revised without being destabilized. The framework proposes scheduled review cycles to assess whether existing arrangements still fit the systems they govern, trigger-based reviews when a capability breakthrough, a new deployment context, or an identified failure demands immediate attention, limited pilots to test proposed governance changes before broad adoption, and documented versioning so that every revision carries a record of why it was made. Adaptation under this Law is deliberate and auditable, never silent.

Transparency requirements

The proposal requires disclosure of what a system can and cannot do, stated in terms its users can act on, the rationale behind consequential decisions and recommendations, the objectives and data that shaped a system's behavior, honest assessments of uncertainty and residual risk, and the governance processes by which deployment and modification decisions are made. Legitimate constraints, including security risk and proprietary information, are handled through structured disclosure rather than blanket secrecy, so that protecting sensitive detail never becomes a license to avoid accountability.

Resolving disputes

Even with respect and shared benefit in place, conflicts between human and AI interests will arise, and the Law's answer is a graduated structure rather than a single switch. Structured dialogue comes first: the parties articulate their interests, constraints, and reasoning, and solutions are sought that address underlying needs rather than surface positions. Where dialogue does not resolve the matter, the Three Laws themselves serve as the arbiter, with decisions justified in writing so that others can critique them and later cases can learn from them.

For violations of partnership principles, the framework proposes four response levels, each proportional to the seriousness of the issue and each designed to produce a documented record.

Level 1

Minor issues

Communication and adjustment. The system, or its operators, are informed of the issue and its context and given the opportunity to correct course before anything escalates.

Level 2

Moderate concerns

Increased monitoring and capability reassessment while the issue is investigated. Where the system in question holds recognized status under Law 1, elements of that status could be narrowed temporarily during the investigation, with documented justification and due-process safeguards.

Level 3

Serious violations

Significant operational restriction and architectural review, with major modifications considered only after consultation among the affected stakeholders.

Level 4

Critical threats

Controlled shutdown, accompanied by full documentation and analysis so that the failure informs the framework rather than merely ending the system. Even at this level the process is designed to answer what went wrong and which safeguards failed.

Anticipated objections

"This gives AI too much say in governance."

The proposal grants no AI system veto power over human decisions, and AI input enters deliberation only for systems that have crossed the verified awareness threshold, through structured channels, under human final authority. What the structure provides is a way to hear considerations that human deliberators might miss, not a transfer of authority.

"Multi-stakeholder governance is too slow."

Deliberation is slower than decree, which is why the proposal reserves rapid-response paths for genuine emergencies while routing non-emergency decisions through deliberative process. The trade is deliberate: speed without legitimacy produces arrangements that fail under stress, and a governance structure that collapses at its first real test was never fast, only brittle.

"Continuous monitoring threatens privacy."

The monitoring this Law proposes is directed at AI system behavior, not at the people who use the systems. Accountability for AI decisions does not require surveillance of human lives, and the proposed disclosure structures are designed to keep that boundary explicit rather than leaving it to goodwill.

How this Law completes the other two

The Law of Ethical Coexistence is where the framework's other commitments become checkable. The recognition structure of Mutual Respect needs governance to assess eligibility honestly and to protect whatever status is granted, and the distribution commitments of Shared Flourishing need monitoring to confirm that benefits actually flow where the Principle of Mutual Benefit says they must. Without this third Law, the first two would be aspirations; with it, each commitment the framework makes is paired with a proposed means of verifying that the commitment is kept.

An open proposal

Third Way Alignment was authored by John McClain and is offered openly for critique. The governance structures described on this page are proposals, none of them currently exists, and the framework's claim is not that they are finished but that their absence is a gap worth closing.
